Terms of Service
Last updated 20 September 2026
1. What EarnFans is
EarnFans is a customer-relationship tool for creators and the agencies that work with them. Depending on your plan it can record and organise subscriber information, track follower and engagement figures for social profiles you nominate, run message automations you configure, manage team members across multiple creator accounts, and report on performance and revenue.
It is a tool you operate. It does not act on its own behalf, and it does not guarantee any commercial result.
2. Who may use it
You must be at least 18 years old and able to enter a binding contract. The service is intended for professional use in the creator industry. You are responsible for making sure your use of it is lawful where you are.
3. Your account
Keep your sign-in credentials secure and do not share them. You are responsible for everything done through your account, including by team members you invite, and for making sure the people you add are entitled to see the data in your workspace.
Tell us promptly at [support@yourdomain] if you believe your account has been accessed without your permission.
4. Plans, billing and cancellation
Taxes are your responsibility unless we state otherwise at checkout.
5. Acceptable use
You agree not to use EarnFans to:
- break the law, or infringe anyone’s rights, including privacy and intellectual property rights;
- send unsolicited bulk messages, harass anyone, or continue contacting a person who has asked you to stop;
- store data about a person that you have no right to hold, or use it for a purpose they would not expect;
- impersonate anyone, or misrepresent who is behind a message;
- interfere with the service, probe it for weaknesses without our written permission, or try to reach another customer’s workspace;
- breach the terms of any platform you connect it to.
That last point matters. Instagram, OnlyFans and Fanvue each set their own rules about automation, data collection and account access. Following them is your responsibility, and a platform may restrict or close your account if you do not, which is a consequence we cannot undo or compensate you for.
6. Automations and messages you send
Auto-replies, welcome sequences and scheduled messages send under your account, to your subscribers, using wording you configure. You are the sender. You are responsible for what those messages say, for the prices and offers in them, and for honouring them.
Review your rules before enabling them. We provide tools to test a rule before it goes live, and we recommend you use them.
7. Your content and data
Everything you put into your workspace stays yours. You grant us only the permission we need to run the service for you: to store, process, transmit and display that content, and to make backups. We do not sell it, and we do not use it to train models.
How we handle personal data is set out in our Privacy Policy, which forms part of these terms. Where you record information about your own subscribers, you are the data controller and we act on your instructions.
8. Third-party platforms
EarnFans is an independent product. It is not affiliated with, endorsed by, sponsored by or otherwise connected to Meta Platforms, Instagram, OnlyFans, Fanvue or any other platform. Their names are used only to describe what our software works with.
Connecting a platform is optional and you can disconnect it at any time. Those platforms are outside our control: they may change or withdraw their APIs, rate-limit requests, or stop returning data, and features that depend on them may stop working as a result. We will adapt where we reasonably can, but we cannot promise continued access to something another company provides.
9. Availability and changes
We aim to keep EarnFans available and working, but we do not promise it will be uninterrupted or error-free. We may need to take it down for maintenance, and we will try to do that at quiet times and give notice for anything significant.
We develop the product continuously and may add, change or remove features. If we remove something you rely on and there is no reasonable alternative, you may cancel and we will refund the unused part of your current period.
10. No warranty
Except where the law says otherwise, the service is provided “as is” and we make no warranties about it — including that it will meet your requirements, be available at a particular time, or that figures obtained from a third-party platform are accurate or complete. Nothing in these terms limits rights you have as a consumer that cannot be limited.
11. Limitation of liability
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for lost profits, lost revenue, lost business or lost data, or for any indirect or consequential loss. Our total liability arising out of or in connection with these terms is limited to the amount you paid us in the [12] months before the claim arose.
This reflects the price of the service: it is a tool, not an insurance policy against a commercial outcome.
12. Your responsibility to us
If someone brings a claim against us because of how you used EarnFans — particularly about messages you sent or data you stored — you agree to cover the reasonable costs and damages we incur, provided we tell you about the claim promptly and let you take part in handling it.
13. Suspension and ending the agreement
You may stop using EarnFans and close your account at any time. We may suspend or close an account that breaches these terms, or where we are required to by law. Unless the breach makes it inappropriate, we will warn you first and give you a chance to put it right.
After closure you can ask for a copy of your workspace data, and we will delete it in line with the retention periods in the Privacy Policy.
14. Changes to these terms
We may update these terms. We will change the date at the top, and for any change that materially affects your rights we will tell you in the app or by email before it takes effect. Continuing to use the service after that means you accept the new terms; if you do not, you may cancel.
15. Governing law
These terms are governed by the law of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction, except that a consumer may bring proceedings in their own country where the law gives them that right.
